I am writing to urge enactment of The Telecommuter Tax Fairness Act. This legislation would eliminate an unfair state tax rule that penalizes employees who telecommute across state lines to their employers.
The state rule is known as the "convenience of the employer" rule. In a state applying the rule, a nonresident who chooses to telecommute part-time to an in-state employer may be required to pay taxes to both his home state and the
employer's state on the income the telecommuter earned at home.
Because the convenience rule subjects nonresident telecommuters to the risk of double taxation, it discourages telework.
The United States cannot afford to slow the growth of telework. Telework enables Corporate America to maximize productivity and reduce costs significantly. Telework can help the country reduce oil consumption, gas prices, air pollution, road congestion, and transportation spending. It can help Americans balance work and family demands. It can help people with disabilities and older Americans contribute to our economy.
Telework can help rural communities expand their economies, and it can stem the loss of American jobs to offshore sites. Telework also assures that our government and businesses can continue operating when terror threats or other emergencies occur.
To help achieve these essential goals, Congress must abolish the convenience rule and pass The Telecommuter Tax Fairness Act now.
